MyBooth Terms of Service

DRAFT for attorney review. Not in effect. Last updated October 21, 2026 (draft).

These Terms are an agreement between [COMPANY LEGAL NAME], a [STATE] [LLC/corporation] ("MyBooth", "we") and the business or professional who creates an account ("you"). By creating an account you agree to these Terms, the Privacy Policy and the Data Processing Addendum.

1. What MyBooth is MyBooth is software for beauty and wellness professionals to keep client records, charts, intake and consent forms, photos and appointments, and to send messages and payment links to their clients. MyBooth is a record-keeping tool. It is not a medical device and does not give medical, health or professional advice.

2. Your account - You must be at least 18 and able to form a binding contract. - You are responsible for everyone you invite to your account and for keeping sign-in details secure. - Tell us promptly at [SUPPORT EMAIL] if you think your account has been accessed without permission.

3. Your responsibilities as a professional - Licensing and scope. You are solely responsible for holding the licenses your work requires and for staying within your legal scope of practice. Services, chart fields, intake questions and warnings in MyBooth are general starting points, not legal or clinical guidance. - Your forms. Intake questions, consent wording and patch-test rules are templates. You are responsible for adapting them to your state's rules, your insurer's requirements and your services. - Client consent and notices. You are responsible for having a lawful basis to collect and use your clients' information, including health-related answers and photos, and for honoring their choices (for example, photo posting and texting consent). - Records. You are responsible for keeping records for as long as your state requires. You can export your data at any time. - Messages. You may only message clients who have agreed to receive them. You are responsible for compliance with texting and email laws for messages sent from your account. - Payments. Payment links open your own accounts with third-party providers (such as Stripe, Square, PayPal, Venmo, Cash App or Zelle), whose terms govern those payments. MyBooth does not hold your clients' money. If you connect Stripe through Stripe Connect, card payments go to your Stripe account and Stripe pays MyBooth's service fee (section 7) to us directly. You are responsible for using accounts permitted for business use and for refunds, disputes and taxes. - Showing the service fee. Where your state requires the total price, including fees, to appear in your advertised prices or menu, you are responsible for showing it that way. [Attorney: confirm against state surcharge and all-in pricing laws; see docs/legal/surcharge-laws-by-state.pdf.]

4. Health insurance billing (HIPAA) MyBooth is not designed for providers who are covered entities under HIPAA (for example, those who bill health insurance electronically). Do not use MyBooth to store protected health information of insurance-billed clients unless we have signed a Business Associate Agreement with you.

5. Acceptable use Do not use MyBooth to break the law, send unsolicited messages, upload content you don't have rights to, store data of people who haven't agreed to it, attempt to access other accounts, or interfere with the service.

6. Your data - You own the client records and content you put into MyBooth ("Your Data"). You give us permission to host, process and transmit Your Data only to provide and improve the service for you, as described in the Data Processing Addendum. - You can export Your Data at any time from Settings. - When a team member leaves, client records follow the ownership setting you choose in Settings and any agreement between you and that team member.

7. Fees Subscription. MyBooth is billed monthly per business on the plan you choose ([Solo: $[X]/month; Studio: $[Y]/month]). New accounts start with a [30]-day free trial. Subscriptions renew each month until cancelled, through our payment processor, Stripe. We will give at least [30] days' notice of a price change. [Attorney: taxes and refund policy.]

Service fee (2.6%). When you send a client a payment request through MyBooth, a service fee of 2.6% of the service amount is added on top of what your client pays. The fee is never charged on tips or on payments you record as cash. It is shown to your client before they pay, as its own line in the payment message, at checkout and on the receipt.
- Stripe connected through Stripe Connect: the fee is taken from the card payment automatically and paid to MyBooth by Stripe.
- All other payment links (for example Venmo, Cash App, Zelle, PayPal, Square, or Stripe without Connect): your client pays the fee to you along with the rest of the payment. MyBooth totals these fees each month and adds them to your subscription invoice on the 1st.
- You can see fees collected and not yet billed under Billing.

Late or failed payment. If a subscription or fee payment fails, we will tell you and may limit new payment requests until it is paid. Your records stay readable and exportable.

[Attorney: confirm the fee wording, whether it is a "surcharge" in any state where it is used, and disclosure requirements.]

8. Ending your account You can close your account at any time. We may suspend or close accounts that violate these Terms. After closing, you will have [30] days to export Your Data, after which we delete it as described in the Privacy Policy, except where the law requires us to keep it.

9. Disclaimers MyBooth is provided "as is". To the fullest extent the law allows, we disclaim implied warranties, including fitness for a particular purpose. We do not guarantee the service will be uninterrupted or error-free. Keep your own exports.

10. Limitation of liability To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data, and our total liability is limited to the fees you paid us in the [12] months before the claim. [Attorney to tailor.]

11. Indemnity You will defend and indemnify MyBooth against claims arising from your services to clients, your forms and records, your messages, your payment accounts, or your breach of these Terms.

12. Disputes [Governing law: [STATE]. Dispute resolution, arbitration and class-action waiver to be decided with counsel.]

13. Changes We may update these Terms. We will notify you of material changes at least [30] days before they take effect.
